Infigen’s Response to Currandooley Fire Statement of Claim

4 May 2017

On Tuesday, 3 May 2017 Infigen Energy was served with legal proceedings, which have been filed in the Supreme Court of New South Wales.

The proceedings were filed by Maddens Lawyers as a representative proceeding for lead plaintiffs Manfred Kuhn and Elizabeth Kaye Stewart on their own behalf and on behalf of an unnamed group of plaintiffs.

The proceedings allege that the plaintiffs suffered loss and damage by reason of the bushfire that commenced on 17 January 2017 in the vicinity of Tarago and attribute responsibility for the loss and damage to Infigen.  In statements to the media, Maddens Lawyers claim that the quantum of the loss could reach $20 million. No information has been provided to Infigen to support this amount, nor has the amount of the loss and damage claimed been quantified in the Statement of Claim.

Infigen denies any liability in respect of the alleged loss and damage and will work with its legal advisers to defend the proceedings accordingly. Infigen maintains appropriate insurance.
